The U.S. Patent and Trademark Office (USPTO) First-Time Filer Expedited Examination Pilot Program offers a huge advantage for new inventors looking to navigate the patent process more quickly. In 2024, the initiative was extended until March 11, 2025, or until 1,000 petitions are granted. As of February 3, 2025, 372 applications have been granted special status under the First-Time Filer program, so it is unlikely that the 1,000 petition quota will be reached.

By reducing the time it takes to receive feedback and advance through the patent process, this program enables new inventors to bring their innovations to market more rapidly. Instead of waiting the average 16 months for their first office action, participants in this program can expect to receive it within just 28 days of being placed on an examiner’s special docket. There are no additional fees to participate, as eligible applicants only need to cover the standard patent application costs. To be eligible, applicants must be first-time filers of a nonprovisional utility patent application, qualify for micro entity status based on income, and complete basic training on the USPTO’s patent application process.
